The land(s) that is/are the subject of the Permit is/are legally described as: PID: 015-966-852; STRATA LOT 41 DISTRICT LOT 7135 STRATA PLAN VR. 2639 TOGETHER WITH AN INTEREST IN THE COMMON PROPERTY IN PROPORTION TO THE UNIT ENTITLEMENT OF THE STRATA LOT AS SHOWN ON FORM 1, as shown on the map attached to this notice.
The purpose of the Permit is vary Whistler’s Zoning and Parking Bylaw 303, 2015 to allow the owners of the subject property to construct stairs and retaining walls in setback areas, as follows: stairs within 1.0 metre of the side (north) parcel line and 2.5 metres of the front parcel line; retaining walls within 2.0 metres of the side (north) parcel line and 5.4 metres of the front parcel line; and retaining walls within 0.0 metres of the side (south) parcel line and 4.8 metres of the front parcel line.
Without the proposed variance, stairs and retaining walls are not permitted in the 3 metre side setback area or 7.6 metre front setback area, unless these landscape features are less than 0.6 metres in height and provided they are also setback at least one metre from any side and two metres from any front or rear parcel line.
